These Terms and Conditions govern your use of the Photon Leads website and services. By submitting your information through our platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not agree, please do not use this website or submit your details.
1. Introduction and Acceptance of Terms
Photon Leads operates a digital lead generation platform that connects Australian consumers who are interested in solar energy solutions with accredited solar installation providers. Our platform captures consumer inquiries through social media advertising and other digital channels, and facilitates the connection between consumers and qualified solar providers to obtain installation quotes.
By accessing or using the Photon Leads website located at https://photonleads.com (the "Website"), completing any lead submission form, participating in an automated voice agent call initiated by or on behalf of Photon Leads, or otherwise engaging with our services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Definitions and Interpretation
- Accredited Solar Provider — a solar installation company that holds current accreditation with Solar Accreditation Australia (SAA) or such other accreditation body as required under Australian law, and that has agreed to Photon Leads' provider terms of engagement.
- Australian Consumer Law — Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.
- Lead Information — the personal and property-related information you submit via the Website, including but not limited to: first name, last name, email address, phone number, residential address, electricity bill amount or projected bill value, and any other information provided in connection with obtaining a solar quote.
- Personal Information — information or an opinion about an identified individual, or an individual who is reasonably identifiable, as defined under the Privacy Act 1988 (Cth).
- Service — the lead generation and referral services provided by Photon Leads, including the Website, lead submission forms, voice agent calls, and transmission of Lead Information to Accredited Solar Providers.
- Voice Agent — an automated artificial intelligence-powered telephony system used by or on behalf of Photon Leads to contact you by telephone to verify, supplement, or qualify your Lead Information prior to referral to an Accredited Solar Provider.
- Website — the Photon Leads website and all associated pages, subdomains, landing pages, and digital assets operated by Photon Leads.
3. Eligibility
- Be at least 18 years of age
- Be a resident of Australia
- Have the legal authority to make decisions regarding the installation of solar panels or energy systems at the nominated property
- Provide accurate, current, and complete information as required by the lead submission form
- Not be acting on behalf of a solar installation company, competitor, or any business seeking to collect information about our network of Accredited Solar Providers
By using the Service, you represent and warrant that you meet all eligibility requirements. Photon Leads reserves the right to refuse service or cancel any submission if it reasonably believes eligibility criteria have not been met.
4. Description of Service
Photon Leads operates as a solar lead generation and referral intermediary. We advertise through social media platforms and other digital channels to connect consumers who are interested in obtaining solar energy system quotes with accredited solar installation providers operating in their area.
We do not sell solar panels, batteries, inverters, or any related equipment. We do not provide solar installation services. We are not an energy retailer. Our role is solely to collect and transmit your Lead Information to Accredited Solar Providers for the purpose of enabling them to contact you and provide a quote.
4.2 Lead Submission
When you complete a lead submission form on the Website or through an associated social media advertisement, you provide us with your Lead Information. By submitting the form, you expressly consent to:
- The collection and processing of your Lead Information by Photon Leads
- Being contacted by a Photon Leads Voice Agent to verify or supplement your Lead Information
- The transmission of your Lead Information to one or more Accredited Solar Providers
- Being contacted directly by Accredited Solar Providers by phone, email, or SMS for the purpose of providing you with a solar installation quote
4.3 Voice Agent Calls
Following your lead submission, Photon Leads or its authorised representatives may contact you via an automated Voice Agent system by telephone. You expressly consent to receiving such Voice Agent calls by submitting your Lead Information. You acknowledge that calls may be made by an artificial intelligence voice system, not a human agent. Calls may be recorded for quality assurance, compliance, and verification purposes.
Voice Agent calls will be made during permitted calling hours in accordance with the Telecommunications (Telemarketing and Research Calls) Industry Standard 2017 (Cth) — that is, between 9:00 am and 8:00 pm Monday to Friday, 9:00 am to 5:00 pm Saturday, with no calls on Sundays or Australian public holidays, unless you have expressly consented to calls outside these hours.
4.4 Referral to Accredited Solar Providers
Upon completion of the lead qualification process, your Lead Information will be transmitted to Accredited Solar Providers who service your area. These providers will contact you independently to arrange a site assessment and provide you with a solar installation quote.
Photon Leads does not guarantee the number of providers who will contact you, the timing of contact, or the pricing or suitability of any quotes provided.
5. User Obligations and Prohibited Conduct
You warrant that all Lead Information and other information you provide to Photon Leads is accurate, truthful, complete, and not misleading. You agree to promptly notify us of any changes to your information.
5.2 Prohibited Use
You must not use the Website or Service for any purpose that is unlawful, harmful, or contrary to these Terms. Without limiting the foregoing, you must not:
- Submit false, misleading, or fraudulent Lead Information
- Use the Service to collect information about Accredited Solar Providers or for any competitive purpose
- Submit multiple lead forms using false or third-party identities
- Use any automated systems, bots, scrapers, or similar tools to access or interact with the Website
- Interfere with, disrupt, or damage the Website or its associated infrastructure
- Attempt to gain unauthorised access to any part of the Website, our systems, or any associated databases
- Reproduce, distribute, or exploit any content on the Website for commercial purposes without our express written consent
6. Intellectual Property
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for the sole purpose of obtaining solar installation quotes through the Service. This licence does not permit you to:
- Copy, reproduce, or republish any part of the Website
- Use any content for commercial purposes
- Modify, adapt, translate, reverse engineer, or create derivative works from any content
- Remove or alter any copyright or proprietary notices
The Photon Leads name, logo, and all associated branding are trademarks or trade names of Photon Leads. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.
7. Relationship with Accredited Solar Providers
While Photon Leads endeavours to refer Lead Information only to providers who hold current accreditation with Solar Accreditation Australia (SAA) and who comply with relevant Australian industry standards, Photon Leads:
- Does not endorse, recommend, or guarantee the services, products, workmanship, pricing, or conduct of any Accredited Solar Provider
- Does not warrant that any Accredited Solar Provider will contact you, or contact you within any particular timeframe
- Does not warrant that any quote provided to you will be accurate, suitable for your property, or competitive
- Is not responsible for any agreement you enter into with an Accredited Solar Provider, including any financial commitments, warranties, or disputes arising from that agreement
Any complaints or disputes relating to quotes, installations, or conduct by an Accredited Solar Provider should be directed to that provider, Solar Accreditation Australia, the Clean Energy Regulator, your state or territory consumer protection agency, or the ACCC as appropriate.
8. Disclaimers
The information provided on the Website, including any estimates of potential savings, payback periods, electricity bill reductions, or government rebate amounts, is general information only and does not constitute financial advice, energy advice, or any professional advice of any kind. The figures provided are indicative only and are based on general assumptions that may not apply to your specific circumstances. You should obtain independent professional advice before making any financial decision in relation to the purchase, installation, or financing of a solar energy system.
8.2 Website Availability
While we endeavour to ensure that the Website is available at all times, we do not guarantee uninterrupted or error-free operation. We may suspend, withdraw, or restrict access to all or any part of the Website at any time without notice for operational, maintenance, or security reasons.
8.3 Accuracy of Information on Website
We take reasonable care to ensure that information published on the Website is accurate and current. However, the Website may contain information about government rebates, solar technology, feed-in tariffs, and related matters that may become outdated. We do not warrant the accuracy, completeness, or currency of any information on the Website and recommend that you verify information with relevant government agencies, your state energy regulator, and the Clean Energy Regulator.
9. Limitation of Liability
To the maximum extent permitted by applicable Australian law, Photon Leads, its directors, officers, employees, agents, and contractors shall not be liable for any loss or damage of any kind, whether direct, indirect, consequential, incidental, special, or punitive, arising out of or in connection with:
- Your use of, or inability to use, the Website or Service
- Any errors, omissions, or inaccuracies in the information on the Website
- The conduct, services, or products of any Accredited Solar Provider
- Any unauthorised access to or use of your Lead Information
- Any interruption, suspension, or termination of the Website or Service
9.2 Cap on Liability
To the maximum extent permitted by law, Photon Leads' total aggregate liability to you for any loss or damage arising out of or in connection with these Terms or the Service shall not exceed the sum of one hundred Australian dollars (AUD $100.00).
9.3 Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that you may have under the Australian Consumer Law (ACL) or any other applicable Australian consumer protection legislation. If any guarantee, condition, or warranty is implied by law and cannot be excluded, our liability for a breach of such guarantee, condition, or warranty is limited, to the extent permitted by law, to the re-supply of the service or payment of the cost of having the service re-supplied.

- Your breach of these Terms
- Your submission of false, inaccurate, or misleading Lead Information
- Your violation of any applicable law or regulation
- Any third-party claim arising from your conduct in connection with the Service
11. Privacy and Communications
The collection, use, storage, and disclosure of your Personal Information by Photon Leads is governed by our Privacy Policy, available at https://photonleads.com/privacy. Our Privacy Policy forms part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
11.2 Consent to Contact
By submitting your Lead Information, you expressly consent to being contacted by Photon Leads, its Voice Agent systems, and Accredited Solar Providers via telephone (including automated calls), email, and SMS. This consent constitutes express consent for the purposes of the Do Not Call Register Act 2006 (Cth), the Spam Act 2003 (Cth), and the Telecommunications (Telemarketing and Research Calls) Industry Standard 2017 (Cth), even if your telephone number is registered on the Do Not Call Register.
11.3 Withdrawal of Consent
You may withdraw your consent to be contacted at any time by contacting us at privacy@photonleads.com or by using the opt-out mechanism provided in any communications from us. Please note that withdrawal of consent may result in Photon Leads being unable to connect you with Accredited Solar Providers.
11.4 Call Recording
You acknowledge and agree that Voice Agent calls and any other calls made by Photon Leads may be recorded. You will be notified at the commencement of any recorded call. Recording may occur for the purposes of quality assurance, compliance verification, training, dispute resolution, and regulatory compliance. Call recordings are handled in accordance with our Privacy Policy and applicable state and territory surveillance device legislation.
13. Government Rebates and Incentives — Disclaimer
The availability and value of government rebates or incentives applicable to your circumstances will be determined by the relevant Accredited Solar Provider and the applicable government agency. Photon Leads does not represent or warrant that any particular rebate or incentive will be available to you.
References to government programs, including the Small-scale Renewable Energy Scheme administered by the Clean Energy Regulator, and state-specific rebate programs (including those available in Victoria, New South Wales, Queensland, South Australia, Western Australia, Tasmania, the Australian Capital Territory, and the Northern Territory), are for general informational purposes only.
14. Amendments to Terms
It is your responsibility to review these Terms periodically. Your continued use of the Website or Service following the posting of updated Terms constitutes your acceptance of those changes.
For material changes that may significantly affect your rights, we will endeavour to provide notice via email (if you have provided us with your email address) or through a prominent notice on the Website.
15. Suspension and Termination
Termination of access does not affect any rights or obligations that have accrued prior to termination, or any obligations that by their nature should survive termination, including clauses relating to intellectual property, limitation of liability, indemnification, and governing law.
16. Third-Party Links and Content
Photon Leads has no control over, and accepts no responsibility for, the content, privacy practices, or terms of any third-party website. You access third-party websites entirely at your own risk and subject to the terms and conditions of those websites.
17. Governing Law, Jurisdiction, and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and, where applicable, the Federal Court of Australia.
17.2 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or in connection with these Terms or the Service, the parties agree to attempt to resolve the matter through good faith negotiation in the first instance. If the dispute is not resolved within twenty-eight (28) days of written notice, the parties agree to submit the dispute to mediation administered by the Australian Disputes Centre (ADC) before resorting to litigation.

18. General Provisions
- Entire Agreement — these Terms, together with the Privacy Policy and any other notices or policies published on the Website, constitute the entire agreement between you and Photon Leads with respect to the subject matter hereof.
- Severability — if any provision of these Terms is found to be invalid, illegal, or unenforceable, such provision shall be severed and the remaining provisions shall continue in full force and effect.
- Waiver — no failure or delay by Photon Leads in exercising any right under these Terms shall constitute a waiver of that right.
- Assignment — Photon Leads may assign, transfer, or novate its rights and obligations under these Terms to a third party without your consent. You may not assign any of your rights or obligations without our prior written consent.
- Force Majeure — Photon Leads shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including acts of God, natural disasters, acts of government, cyberattacks, telecommunications failures, or pandemic conditions.
- Language — these Terms are written in the English language, which shall be the controlling language for all purposes.

12. Social Media Advertising and Lead Capture
The collection of your information through third-party platforms is also subject to the terms, conditions, and privacy policies of those platforms. Photon Leads is not responsible for the privacy practices of third-party social media platforms.
Photon Leads' social media advertising complies with the advertising policies of relevant platforms and with Australian advertising standards, including those set by the Australian Association of National Advertisers (AANA) and, where applicable, the advertising standards applicable to the energy sector.
